Diggs v. Kawasaki

This was a product liability case filed against the Defendant, Kawasaki, for the defective design of the Kawasaki 300 Bayou all terrain vehicle. This case was filed in Circuit Court of Garland County at Hot Springs, Arkansas. In this case, Plaintiff Dudley Diggs was operating his Kawasaki Bayou 300 up an incline when he lost traction. Once retraction was regained the all terrain vehicle flipped over, front to rear, rendering Dudley Diggs a complete quadriplegic. This case was settled shortly before trial for a confidential settlement. Plaintiff's counsel was Ralph E. Chapman of CHAPMAN, LEWIS & SWAN, and David Blair of Blair & Stroud, Batesville, Arkansas. Defense counsel was Michael L Alexander of Little Rock, Arkansas, and Tilden P. Wright, III, of Fayetteville, Arkansas.
