Willie
Townsend v. Tackett Farms
Plaintiff Willie Townsend, a farm worker, was employed
by the defendant to clean out a grain deposit area on
his employer's farm. The area assigned to Willie Townsend
was one where the harvested grain would be dumped and
thereafter augured into one of several large grain bins.
Townsend's job, as assigned to him, was to climb into
the bottom of this pit and to sweep grain down from
the sides and into the middle so that the auger could
carry the grain to the various grain bins. The auger
had no guard on it and had no guard on it for more than
one year and exposed Willie Townsend to severe injury
which he could not see since the bottom of the auger
was covered with grain. Within the course of his work
he slipped and was caught in the end of the auger. The
auger twisted one of his legs to the hip while breaking
the other leg. He laid trapped in the auger for more
than two hours. Eventually suffered the loss of one
leg and the severe injury to the other. Defendants settled
this case shortly before Trial for a confidential sum.
